This Privacy Policy describes how lamerlighting inc. ("Lamer Lighting", "we", "us", "our") collects, uses, and discloses your personal information when you visit lamerlighting.com (the "Site"), make a purchase, or otherwise communicate with us.
1. Personal information we collect
Information you give us
- Order information: name, billing address, shipping address, email address, phone number, and the contents of your order
- Payment information: your card or bank details are collected and processed by our payment processors. We do not receive or store full card numbers.
- Communications: the content of emails, contact-form submissions, customisation requests, and any photos or videos you send us in support of a return or warranty claim
- Marketing preferences: your email address if you subscribe to our newsletter
Information collected automatically
- Device and usage information: IP address, browser type and version, operating system, time zone, referring URLs and search terms, the pages and products you view, and how you interact with the Site
- Cookies and similar technologies: cookies, log files, pixels, tags, and web beacons
2. How we use your information
- To fulfil your order — processing payment, arranging manufacture and shipping, and sending confirmations, invoices, and tracking
- To provide customer service and to handle returns, refunds, and warranty claims
- To screen orders for fraud and risk
- To operate, secure, improve, and optimise the Site
- To send marketing emails, where you have opted in — you can unsubscribe at any time using the link in any marketing email
- To measure and improve our advertising, including measuring which ads lead to purchases
- To comply with our legal obligations, including tax and accounting requirements
3. Who we share your information with
We do not sell your personal information for money. We share it with the service providers we need in order to run the business, and only what each one needs:
- E-commerce platform and hosting: Shopify Inc., which hosts our store and processes orders on our behalf
- Payment processors, to authorise and settle your payment and to screen for fraud
- Manufacturing and fulfilment partners, including our partner facilities in China, which manufacture, pack, and dispatch your fixture. They receive the shipping details needed to deliver your order.
- Shipping carriers and freight forwarders — including UPS, FedEx, DHL, USPS, and the ocean and final-mile freight carriers we use for oversized fixtures — which receive your name, address, and phone number to complete delivery and customs clearance
- Analytics and advertising providers, currently Google (Google Analytics, and Google Ads conversion measurement and remarketing) and TikTok (advertising pixel). These providers set cookies and receive information about your activity on the Site so that we can measure and target our advertising. - Email and customer-service tools we use to communicate with you
We may also disclose personal information to comply with applicable law or a lawful request, to enforce our terms, to protect our rights, or in connection with a merger, acquisition, or sale of assets.
Because we work with advertising and analytics providers that set cookies across sites, some of this activity may be considered "sharing" for targeted advertising, or a "sale", under certain U.S. state privacy laws. See Section 6 for how to opt out.
4. Cookies and tracking
We use cookies and similar technologies to keep your cart and preferences, to understand how the Site is used, to protect against fraud, and to measure and target advertising. For the cookies Shopify sets to power our store, see shopify.com/legal/cookies.
You can block or delete cookies in your browser settings. Doing so may affect parts of the Site, such as the cart and checkout.
Global Privacy Control. We honour the Global Privacy Control (GPC) signal. If your browser or extension sends a GPC signal, we treat it as a request to opt out of targeted advertising and of any sharing or sale of your personal information for that browser.
5. How long we keep it
We keep order information for as long as needed to fulfil and support your order, and after that for as long as required to comply with our legal, tax, and accounting obligations and to resolve disputes or enforce our agreements — generally seven years from the date of the order. We keep marketing contact details until you unsubscribe. Device and analytics information is retained for a shorter period, as set by each provider.
6. Your privacy rights
Depending on where you live, you may have some or all of the following rights:
- Access — to know what personal information we hold about you and how we use it
- Correction — to have inaccurate or incomplete information corrected
- Deletion — to ask us to delete personal information we collected from you, subject to the records we are legally required to keep
- Portability — to receive a copy of your information in a portable format
- Opt out of targeted advertising, of the sale or sharing of your personal information, and of profiling in furtherance of decisions with significant effects
- Opt out of marketing at any time
- Non-discrimination — we will not treat you differently for exercising these rights
How to exercise them. Email info@lamerlighting.com with the request and enough information for us to locate your records. We will respond within 45 days and may extend that period once where permitted, telling you why. To opt out of targeted advertising specifically, you can email us, or send a GPC signal from your browser as described in Section 4.
Authorised agents. You may use an authorised agent to submit a request on your behalf. We may ask the agent for proof of authority and ask you to verify your identity directly.
Right to appeal. If we decline your request, we will tell you why, and you may appeal by replying to our decision or emailing info@lamerlighting.com with "Privacy Appeal" in the subject line. We will respond to an appeal within 45 days. If your appeal is denied, Colorado residents may contact the Colorado Attorney General, and residents of other states may contact their own Attorney General.
7. Children
The Site is intended for adults. We do not knowingly collect personal information from children under 13, and we do not sell or share the personal information of consumers under 16. If you are a parent or guardian and believe your child has given us personal information, email info@lamerlighting.com and we will delete it.
8. Security
We take reasonable precautions and follow industry practice to protect your personal information against loss, misuse, unauthorised access, disclosure, alteration, and destruction. Traffic to and from the Site is encrypted in transit. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
9. International transfers
We are based in the United States. Because our manufacturing and fulfilment partners are located in China, and some of our service providers operate internationally, your information may be transferred to and processed in countries other than your own, including China. We take steps to ensure our partners handle your information consistently with this policy and only for the purposes described here.
10. Third-party links
The Site may link to third-party websites. We are not responsible for their content or privacy practices. Please review their policies before providing information to them.
11. Changes to this policy
We may update this policy from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. We will post the updated version here and change the "Last updated" date above.
